BloomSky warrants the product hardware components ('Product') against defects in material and workmanship when used in accordance with BloomSky’s instruction for a period of ONE (1) YEAR after the date of original retail purchase ('Warranty Period').
Bloomsky’s sole obligation under this warranty will be at its option to repair or replace the product. This warranty does not apply to products damaged by misuse, accident, or normal wear and tear. The product is not designed for or warranted against damage from use in areas subject to electrical interference, extreme hot or cold condition (out of the operating temperature range of BloomSky Outdoor Station), immersion under water, or other inherently hazardous environments. In addition, Bloomsky does not warrant the accuracy of weather data or forecasts obtained from use of the product.
BloomSky’s warranty obligations are conditioned on Customer (i) notifying BloomSky at support@bloomsky.com during the Warranty Period of any failure of the Product to meet the Limited Warranty, including a detailed description of the alleged failure, (ii) shipping, at Customer's cost, the affected Product to BloomSky for repair or replacement, and (iii) providing BloomSky with valid proof of purchase. If BloomSky determines, after analysis of a returned Product, that the Product is an Ineligible Product (see Document and Section of Included Documentation), BloomSky will no longer have warranty obligations. BloomSky will bear all costs of return shipping to Customer, except with respect to any Ineligible Product, for which Customer will bear all shipping costs.
ALL IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED TO THE DURATION OF THIS WARRANTY. BLOOMSKY DISCLAIMS ALL OTHER EXPRESS OR IMPLIED WARRANTIES OR CONDITIONS. TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT WILL BLOOMSKY BE LIABLE FOR ANY SPECIAL, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES, HOWEVER CAUSED, ARISING OUT OF OR RELATED TO THE USE OF OR INABILITY TO USE THE PRODUCT, EVEN IF BLOOMSKY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL BLOOMSKY’S LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE PRODUCT.
Some jurisdictions do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights, which vary by jurisdiction.
If, for any reason, you want to return the Product you purchased from the Store for a refund, you must notify us no later than 30 days following the date of purchase (the "Cancellation Period"). To initiate a return, you must inform us of your decision within the Cancellation Period by contacting BloomSky Customer Care at support@bloomsky.com and clearly stating your desire to return the Product. Although it will not affect your right to a refund, please include details on where and when you purchased the Product and your reason for returning the Product. If you purchased the Product from somewhere other than the Store, please contact that reseller to obtain a refund.
To receive a refund, you must return your Product (and any promotional merchandise supplied with the Product) within the 14 days following the day on which you notify BloomSky Customer Care that you desire to return your Product. Unless the Product is faulty or not as described, you will be responsible for all costs associated with returning the Product to us (including uninstallation and the cost of shipping the Product back to BloomSky).
We will refund the price you paid for the Product plus original delivery cost (up to the value of our Ground delivery option), less the value of any promotional merchandise you received. We may reduce the amount of your refund to reflect any reduction in the value of the Product caused by your handling them in a way which goes beyond what is necessary to establish their nature, characteristics and functioning (e.g., beyond what would normally be permitted in a shop).
We will process the refund due to you as soon as possible and, in any case, within 30 days from the date of receipt by BloomSky of the returned Product. The Product is not eligible for a refund after the 30-day period.
